1. Acceptance of Terms

Welcome to D2D Pickup. By accessing or using our delivery scheduling and route planning platform at www.d2dpickup.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

2. Description of Service

D2D Pickup provides a web-based platform that enables:

  • Drivers to manage their availability, accept pickup requests, and plan optimal routes
  • Customers to find drivers, schedule pickups, and track their delivery requests
  • Communication between drivers and customers for coordination purposes

D2D Pickup is a platform service only. We do not provide delivery services ourselves and are not responsible for the actual pickup or delivery of items.

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information including your name, email address, phone number, and physical address. You must choose whether to register as a Driver or Customer.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities conducted through your account

3.3 Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. User Obligations

4.1 Driver Obligations

As a Driver, you agree to:

  • Accurately set your availability and capacity
  • Honor confirmed pickup requests or provide timely cancellation notice
  • Provide professional and courteous service
  • Handle customer items with care
  • Maintain appropriate licensing, insurance, and permits required in your jurisdiction
  • Comply with all applicable laws and regulations

4.2 Customer Obligations

As a Customer, you agree to:

  • Provide accurate pickup and delivery information
  • Ensure items are ready for pickup at the scheduled time
  • Communicate any special requirements or restrictions
  • Pay drivers directly as agreed upon
  • Treat drivers with respect and professionalism

4.3 Prohibited Activities

You agree NOT to:

  • Use the Service for any illegal purpose
  • Ship prohibited, dangerous, or illegal items
  • Harass, abuse, or harm other users
  • Impersonate another person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools to access or scrape the Service
  • Reverse engineer or copy any part of the Service

5. Payments and Fees

Currently, D2D Pickup is provided free of charge. We reserve the right to introduce fees for the Service in the future. If fees are introduced, we will provide you with advance notice and you will have the option to continue using the Service or terminate your account.

Payment arrangements for pickup and delivery services are made directly between Customers and Drivers. D2D Pickup is not involved in these transactions and does not collect payment on behalf of drivers.

6. Platform Relationship

D2D Pickup provides a platform to connect Drivers and Customers. We are not:

  • A delivery or courier company
  • An employer of Drivers
  • A party to any agreement between Drivers and Customers
  • Responsible for the actual pickup, transport, or delivery of items

Drivers are independent contractors and are solely responsible for their own services, insurance, taxes, and compliance with applicable laws.

7. Intellectual Property

The Service, including its design, features, graphics, and software, is owned by D2D Pickup and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranty that the Service will be uninterrupted or error-free
  • Warranty that the Service will meet your requirements
  • Warranty regarding the reliability, quality, or safety of drivers or deliveries

You use the Service at your own risk. We do not guarantee the accuracy, completeness, or reliability of any information on the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, D2D PICKUP SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to or loss of items during pickup or delivery
  • Actions or omissions of Drivers or Customers
  • Delays, cancellations, or failures to deliver
  • Any disputes between Drivers and Customers

IN NO EVENT SHALL D2D PICKUP'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless D2D Pickup and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any pickup or delivery services arranged through the Service

11. Account Termination

11.1 By You

You may terminate your account at any time by contacting us at jpiccampbell@yahoo.com.

11.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Any reason at our sole discretion

12. Dispute Resolution

Any disputes between Drivers and Customers should be resolved directly between the parties. D2D Pickup is not responsible for mediating or resolving such disputes.

Any disputes between you and D2D Pickup shall be governed by the laws of Canada. You agree to submit to the exclusive jurisdiction of the courts located in Canada.

13. Third-Party Services

Our Service uses third-party services including Google Maps, Firebase, and EmailJS. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or performance of these third-party services.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and D2D Pickup regarding your use of the Service.
